STUDENT RIGHT-TO-KNOW & CAMPUS SECURITY ACT:It is the policy of Texas State Technical College to fully comply with the published mandates of the Students Right-To-Know and Campus Security Act (Public Law 101-542), the Higher Education Technical Amendments of 1991 (Public Law 102-26) the Higher Education Amendments or 1992 (Public Law 102-325), and that each operating unit of the System prepare and follow procedures to satisfy the stipulations of the Act, as amended. |
CERTIFIED LAW ENFORCEMENT PERSONNEL:The TSTC Marshall Department of Public Safety Officers are fully certified State of Texas Peace Officers and have graduated from a Texas Police Academy that has been certified by by the Texas Commission on Law Enforcement Officer Standards and Education, and have all the powers and duties of any State of Texas Peace Officer. Jurisdiction of the TSTC Department of Public Safety shall be within any county in which Texas State Technical College has properties. The qualifications and jurisdictional boundaries have been estab- lished by the State of Texas Legislature, Education Code, Section 51.203. |
REPORT ALL CRIMINAL ACTIVITIES:College crime is a reality. The TSTC Public Safety Officers encourages all staff, faculty and students to become involved in a shared responsibility of the prevention of criminal activity on campus. Anyone observing a crime committed on campus or at any college function should report the crime to the TSCT Public Safety Office. Public Safety Officers will respond to all reports and take appropriate action. Traffic, suspicious activities and criminal conduct are monitored by TSTC Dept. of Public Safety Officers through vehicle patrol and foot patrol procedures to ensure the safety and security of students, staff, faculty and visitors. IF YOU ARE A VICTIM OF SEXUAL ASSAULT:Any person who is the victim of a sex offense which occurs on campus, or at an official off-campus TSTC function, should immediately report such offense to the Public Safety Department and also to local law enforcement officials (the Marshall Police Dept. @911). At the time of the reporting of the incident remain calm and try to the best of your ability to give the following information: Do you need medical attention? Direction of Travel Scars, marks or tattoos on Suspect Suspect's Name (if known) Approximate Age of Suspect Suspect's Clothing Description of Vehicle Suspect's BuildRemember: Do not bathe, shower or clean -up in manner or change clothing until cleared to do so by law enforcement officials or medical authority Victims have the right, and can expect to have incidents of sexual misconduct taken seriously and to have incidents investigated and properly resolved. Victims will be offered assistance in the reporting process and will, to the extent permitted by law, be permitted anonymity, if requested. It is understood that victims may desire confidentiality. However, when an incident is reported to College officials, they have a duty to fully investigate. If it is de- termined that a threat of continuing harm or harassment is present, the College will act to resolve the incident to the extent possible, even without the cooperation of the victim. Complaints and disciplinary actions, unless otherwise provided, are considered confidential and are subject to the provisions of the Family Educational Rights and Privacy Act (Public Law 93-389). If not otherwise provided in Policy and Procedure 2.4, or the Code of Student Conduct, both the victim and the person accused of sexual assault shall: (1) be entitled to have an advisor present during any campus disciplinary proceeding; and (2) be informed of the outcome of the disciplinary proceeding. Discipline, for persons found in violation by appropriate disciplinary procedures, shall include suspension from College or termination of employment. Disciplinary procedures shall proceed regardless of other possible criminal actions. The Campus Disciplinary Officer (or the Student Judicial Review Board) may impose disciplinary action for a sex offense on a student upon finding that a student committed an act of sexual or aggravated sexual assault, including non-forcible sex offenses. The conclusion of the Campus Disciplinary Officer or Student Judicial Review Board shall be based on "preponderance of the information" rather than "proof beyond a reasonable doubt" and need not coincide with legal actions taken by a court of law. Any student who, in the finding of the Campus Disciplinary Officer or Student Judicial Review Board, has committed a sex offense on campus or at an official off-campus College function may be expelled from the College. Students who report that they are the victims of sexual assault on campus may, at their Discretion, request of the Dean of Enrollment Management that their on-campus residence assignment and/or class schedule be changed. Based on the availability of housing units and appropriate class sections, the College will Make reasonable efforts to accommodate such request. DEFINITIONS:Sexual Assault: A person may be guilty of a second degree felony if he/she intentionally or knowingly attempts or completes any sexual act as defined by Article 22.011 of the Texas Penal Code. These acts include: sex without the consent of another person, by force, through the use of a chemical substance, with a child younger than 17 years of age, or if the victim has a mental defect, does not know that the sexual assault is occurring, or is coerced by a public official , mental health provider or minister. Aggravated Sexual Assault: A person may be guilty of a first degree felony if he/she intention- ally or knowingly attempts or completes any sexual act, as defined by Article 22.021 of the Texas Penal Code. These acts include: sex through force that causes serious physical injuries or attempts to cause death by acts or words that place the victim in fear of serious bodily in- jury; kidnapping or death; use of a deadly weapon during the commission of the crime; using an object to commit the acts; acting against the person's will; or when the victim is younger than 14 years of age, older than 65 years of age, or is incapable of giving consent. Non-forcible Sex Offenses: Any act or unlawful, non-forcible sexual intercourse, including incest and sexual assault of a child and criminal offenses of indecency with a child as defined by Article 21.11 of the Texas Penal Code. Forcible Sex Offenses: Any act directed at another person, forcibly and by/or against that person 's will, or not forcible or against the person's will where the victim is incapable of giving consent, and includes any type of sexual assault with an object and forcible fondling. Date/Acquaintance Rape: Depending on the criminal evidence and the criminal intent with- in the act, Date/Acquaintance Rape could fall within either Forcible or Non-forcible Sex Offenses. |

DRUG & ALCOHOL POLICY:TSTC Marshall is a drug-free College and workplace. The unlawful manufacture, distribution, purchase, dispensing, possession or use of illegal drugs or alcohol by students and employees on College property or as part of any campus activity, is prohibited. Disciplinary sanctions may be imposed, including possible suspension and criminal charges being filed. Therefore, students, employees and quest are encouraged to read the full policy, found in the Student Handbook, as all persons are expected to abide by that policy. |
Federal law mandates that Texas State Technical College Marshall must maintain and report
certain violent and non-violent criminal offenses which occur on TSTC Marshall property.
The Department investigates or caused to be investigated all reported criminal offenses, which
occur on College property and these offenses are reported the Uniform Crime Report submitted monthly to the Texas Department of Public Safety.
The Federal law mandates that TSTC Marshall crime statistic information be published for three consecutive years.

As required by federal law, an annual TSTC Police/Security Report shall be prepared, published and distributed by each college to all employees and students of the college by September 1 of each year. This report shall contain elements specified by the Student Right-to-Know and Campus Security Act. Timely reporting of a crime to the college community shall be decided on a case by case basis due to the nature of the crime. The TSTC President shall notify the college community of reported campus crimes that, in the Presidents opinion, constitutes a threat to other students and employees. Such notification shall be broad and timely to reduce potential risk at the college.
